What To Do When Receiving a Notice of Abandonment

Hello I’m Tim Maier. I would like to speak to you today for a minute or two about abandonment.

Your pro say inventor you receive a notice of abandonment from the patent office or patent of trade marketing. Oh no what do I do, well the best thing to do is hire an attorney. Typically, in these scenarios, for example, on the patent side we get inventors that are not usually familiar with the deadlines and terms for particular responses the patent office will issue a notice of abandonment. If the abandonment was unintentional you can file a petition to revive an application for unintentional abandonment. This requires a statement and a fee and typically if you’re diligent from the time of receiving the notice of abandonment and having knowledge of that abandonment to the time you hire an attorney to draft a petition, we find that we’re able to revive many of those cases. By the time we draft the petition, submitting the fees and responding to the outstanding office action is necessary. So if you receive a notice of abandonment from the patent office it is absolutely vital to hire an attorney immediately and get those petitions filed in the PTO as timely as possible.
